HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38320 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the respondents to follow the written instructions of the 2nd respondent dated 6.11.2015 and 14.12.2015. 2.

Heard and perused the material available on record. 3.

It is the case of the petitioner that Sri Kurumoorthy Devastana Brahmotsavams will be held every year in the month of November to December and as per the Endowments Act, selling of meat and chicken in the temple premises is objectionable. If the respondents wanted to allot any shops outside the temple premises, they ought to have given first preference to the members of the association. But unfortunately, instead of allotting the shops to the members of the petitioner-association, the respondents are taking huge amounts from the sellers without there being any valid permission, and they are permitting selling of meat and chicken in the premises of the temple. In spite of representation dated 28.10.2015 to the District Collector, Mahabubnagar and the 2nd respondent, no action has been taken so far.

Considering the facts and circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

"The 2nd respondent is directed to consider the representation of the petitioner-association and dispose of the same in accordance with law."

No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
