CVNR, J & MSKJ, J WP 26486/2017 ORDER: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) Feeling aggrieved by order dt.06.07.2017 in O.A. No.1582 of 2017 on the file of the Andhra Pradesh Administrative Tribunal, at Hyderabad, (hereinafter referred to as "the Tribunal'), the unsuccessful applicant therein filed this writ petition.
The petitioner applied for the post of Stipendiary Cadet Trainee Police Constable (Civil) as well as the Warder in Prisons Department, in pursuance of a Notification for recruitment issued by the State Level Police Recruitment Board, Andhra Pradesh, in the year 2016. As he did not get provisionally selected for the said posts, he filed the aforesaid O.A. before the Tribunal. He has pleaded in the O.A. that having participated in Taekwondo, a sports discipline falling under 2% quota reserved for recognized sports, the petitioner is entitled to be treated under meritorious sports persons (MSP) category. This O.A. having been dismissed by the Tribunal, the petitioner filed this writ petition.
In paragraph 3 of the affidavit of the petitioner, he has averred that he has participated in the 32nd National Taekwondo Championship 2012 and a certificate to this effect was issued by Vizianagaram District Taekwondo Federation, Vizianagaram. The petitioner has filed G.O. Ms. No.74, dt.09.08.2012, in support of his plea that the said G.O. provided for 2% of posts for MSP. The said G.O. contains two Annexures, namely, Annexure-I and Annexure-II. The learned counsel for the petitioner relied upon Sl. No.59 of Annexure-II, which reads: "Silver Medal in National School Games U-19 & U-17". The certificate relied upon and filed by the petitioner shows that the petitioner has participated in the 32nd National Taekwondo Championship 2012.
No material is placed before us by the petitioner to show that he has won any medal, much less silver medal.
CVNR, J & MSKJ, J WP 26486/2017 For a woman to claim reservation under the MSP, it is enough if she participated in the National Championship For Women, while for men, such a right is not conferred unless he wins a medal. Though the learned counsel for the petitioner relied upon Sl. No.59 as noted hereinbefore, the petitioner has neither averred in the affidavit that he has got any medal, nor any material is filed by him in the writ petition to prove that he won a medal. Hence, the petitioner is not entitled to claim any reservation under the MSP quota.
For the aforementioned reasons, we find no merit in the writ petition and the same is accordingly dismissed. As a sequel to dismissal of the writ petition, W.P.M.P. No.32856 of 2017 shall stand disposed of as infructuous.
