This contempt case is {iled alleging that the interim order granted by this Court in I.A.No.1 ol 2Ol9 in W.P.No.18398 of 2019 to consider the case of petitioner for promotion as Senior Assistant without reference to the pending disciplinary proceedings is not complied with and petitioner is not granted promotion. 2.
ln the counter affidavit deposed by Sri D.Amoy Kumar working as Collector and District Magistrate, Ranga Reddy District, it is stated that petitioner was considered for promotion without reference to the disciplinary proceedings, but could not be granted promotion as there was no vacancy ear marked to be fi1led up by open category candidate and he was also given endorsement informing that as and when the open category vacancy arises, he will be considered for promotion.

Learned counsel for the petitioner sought to contend that the counter do not disclose as to how the respondent is saying that there is no vacancy for open category and how roster points are maintained. These are the issues which require consideration in the pending writ petition.

As can be seen from the interim order, the Court only directed consideration without reference to the pending disciplinary proceedings and the respondent has considered the claim of petitioner without reference to the pending disciplinary proceedings, but promotion could not be granted on the ground that slot meant for open category of Village Revenue Officer is not ,l
available. Therefore, i do not see that a case is made out for initiation oI contempt proceedings.
