HON'BLE SMT JUSTICE ANIS M.A.C.M.A.No.2184 of 2005 J U D G M E N T:

When the matter had come up on 03.07.2015, none appeared for the appellant and there was no representation on his behalf, and therefore, the matter was posted under the caption 'for dismissal'. Even today also, when the matter has come up for hearing, none appears for the appellant and there is no representation on his behalf. Therefore, the appellant is not evincing any interest in prosecuting the case.

The Civil Miscellaneous Appeal, is accordingly, dismissed for default. There shall be no order as to costs. Miscellaneous Petitions pending, if any, in this Civil Miscellaneous Appeal shall stand dismissed.
