HON'BLE SRI JUSTICE R. SUBHASH REDDY And HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.37246 of 2015 ORDER : (Per Justice R.Subhash Reddy) In this writ petition, the petitioners have questioned the eauction sale notice, dated 28.09.2015, issued under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, for holding auction of secured asset on 16.11.2015.

While issuing notice before admission, this Court directed not to issue sale certificate on condition of the petitioners depositing a sum of Rs.5,00,00,000/- (Rupees Five Crores). When the matter is called, it is represented by Sri B.S.Prasad, learned counsel appearing for respondent-Bank that the petitioners have not complied with the conditional order of this Court and have not deposited any amount, but auction could not be conducted on the notified date for want of bidders.

As much as the relief sought for in the writ petition is with respect to e-auction sale notice and as the auction is not conducted pursuant to said notice, the subject matter of the writ petition has become infructuous.

Accordingly, the writ petition is dismissed as infructuous. No costs.

Pending miscellaneous applications, if any, shall stand closed.
