THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.12773 OF 2019 ORDER:

The petitioner filed this Writ Petition with the following prayer:- "...to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent-authorities particularly the respondent No.3 authority in calling the petitioner to the Police Station, Kushaiguda, without any case against the petitioner and harassing the petitioner as illegal, arbitrary, unconstitutional and also against the principles of natural justice and to consequentially direct the respondents particularly the respondent authority not to call the petitioner to the Police Station, Kushaiguda and not to harass the petitioner without any case against the petitioner and to pass such other order or orders may deem fit and proper in the circumstances of the case."

Learned Assistant Government Pleader for Home produced written instructions stating that one Ms. Ch. Pavani gave complaint to the Station House Officer, Kushaiguda on 07.01.2019 stating that she knew one Yakub Prathap since six years and they both fell in love. The said Yakub Prathap kept her in his room and assaulted her physically and when she asked him to marry her, he denied marrying her to which his mother, Bharathi and father Yadagiri are also supporting. On receipt of the said complaint, a GD entry was made and informed the matter to the said Yakub Prathap. Both the parties came to Police Station on 11.02.2019 wherein, Ms. Ch.

take any action on her complaint till then. But afterwards, neither Ms. Ch. Pavani nor Yakub Prathap came to Police Station again nor the Station House Officer, Kushaiguda called the petitioner to the Police Station again.

Recording the same, this Writ Petition is disposed of directing the respondents not to interfere with the life and liberty of the petitioner except in accordance with law. There shall be no orders as to costs. Miscellaneous applications, if any, pending shall stand closed.
