Heard the learned counsel for the petitioner and the learned counsel for 5th respondent.

Petitioner's grievance is that the petitioner has not been allotted shop No.14 by 5th respondent in a shopping complex which the 5th respondent had proposed to construct pursuant to a plan approval obtained on 12-07-2010. Petitioner claims to be the highest bidder in a tender-cum-auction conducted 14-092009 for allotment of a shop in the said complex. 3.

Learned counsel for 5th respondent states that the construction of the shopping complex has since been completed and shop No.14 which the petitioner is seeking has already been delivered to the petitioner for occupation and nothing survives in the Writ Petition.

4. This is not disputed by the learned counsel for the petitioner.

5. In this view of the matter, I am of the opinion that the Writ Petition has become infructuous and the same is accordingly dismissed as infructuous. No costs. 6.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
