ORDER:
This Criminal Petition is filed before this Court for grant of bail to the Petitioners who are arrayed as accused Nos.1 and 2 in Crime No.215 of 2026 of Pet Basheerbad Police Station, Medchal Malkajgiri District, registered for the offences punishable under Section 85, 108 r/w 3(5) of The Bharatiya Nyaya Sanhita, 2023 (BNS).

The brief facts of the case are that, on 11.02.2026, the de-facto complainant lodged a report before the police stating that, the complainant's sister, who was allegedly subjected to continuous harassment and assault by her husband and his relative, informed her family that she was being beaten and intended to end her life. Thereafter, she was found hanging in her residence and was declared dead at the hospital. Hence, the complainant requested to take necessary action. Based on the said complaint, the police registered a case against the petitioners for the aforementioned offences. 3.
Heard Sri Bathini Upendar, learned counsel appearing on behalf of the petitioners as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the said allegations and at the time of the incident, the petitioners were not present at the scene of offence. It is further submitted that the petitioners are in jail from 13.02.2026 and the material part of the investigation is already completed. Therefore,
he prayed the Court to grant bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposing the petition stating that the alleged offences against the petitioners are serious and heinous in nature. It is further contended that due to the harassment of the petitioners, the victim has committed suicide. Therefore, he prayed the Court to dismiss the petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners are in jail from 13.02.2026, who are arrayed as accused Nos.1 and 2 and as seen from the record, at the time of incident, the petitioners herein were not present at the scene of offence. The remand report shows that LW1 to LW12 were examined. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of
incarceration, this Court finds it appropriate to grant bail to the petitioners, subject to the following conditions. i.
The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), each with two sureties for a like sum each to the satisfaction of the learned IX Additional Metropolitan Magistrate, Medchal at Medchal Malkajgiri District.
ii.
The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed.
Miscellaneous applications, if any pending, shall stand closed.
