THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY AND THE HON'BLE SRI JUSTICE M. LAXMAN FCA.No.112 OF 2019 JUDGMENT: (Per the Hon'ble Sri Justice A.Rajasheker Reddy) This appeal is filed against order and decree dt.11.03.2019 in HMOP.No.348 of 2015, which is filed by the respondent-husband seeking divorce under Section 13(1)(ia) and III of Hindu Marriage Act, 1955, wherein and whereby the Court below allowed the said OP dissolving the marriage of the petitioner-husband with the appellant herein.

Pursuant to the settlement arrived at between the parties during the conciliation proceedings conducted before this Court on 05.10.2021, both the parties have entered into Memorandum of Understanding dt.22.11.2021 and the same is filed before this Court. When the matter is listed today, both the parties are present in person identified by their respective counsels. It is stated by the learned counsel for the appellant-wife that the appellant has already received an amount of Rs.30 lakhs and including the DD for Rs.10 lakhs handed over by the respondent, today, the appellant received Rs.40 lakhs, in total, towards permanent alimony.

Both the parties state that all the cases have been withdrawn by either parties and they are ready to take mutual divorce in terms of

the Memorandum of Understanding by dissolving the marriage between them.

In view of the above, the Memorandum of Understanding dt.22.11.2021 entered into between the parties is hereby recorded and a decree be drawn in accordance with the terms of Memorandum of Understanding and a copy of the same shall form part of the record. Accordingly, the FCA is disposed of in terms of Memorandum of Understanding dt.22.11.2021 entered into between the parties and the order and decree dated 11.03.2019 passed in HM.OP.No.348 of 2015 on the file of the Judge, Family Court, Secunderabad, is confirmed granting divorce to the parties by mutual consent. As a sequel thereto, miscellaneous applications pending, if any, shall stand closed.
