THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CRIMINAL PETITION No. 3422 OF 2019 O R D E R:

To quash the proceedings in FIR No. 34 of 2019, dated 24.04.2019 on the file of the Court of the Madaram Police Station, this Petition was filed.

The crime was booked against the petitioner - Accused No.1 and another for the offence punishable under Section 420 read with Section 34 of the Indian Penal Code alleging that they had cheated the 2nd respondent and lured him to part with Rs. 2 lacs with a promise to provide him a job.

Heard learned counsel for the petitioner as well as learned Public Prosecutor.

Since the investigation is in progress, interests of justice would be served if a direction is issued to the 1st respondent to follow the law laid down by the Apex Court in Arnesh Kumar v. State of Bihar1.

The Criminal Petition is accordingly, disposed of directing the 1st respondent Investigating Agency to strictly follow the law prescribed in the case of Arnesh Kumar (supra) in the process of investigation into the aforesaid crime.
