THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Criminal Petition No.7852 of 2017 ORDER :

Heard the learned counsel for the petitioners/ A.1 and A.2 in C.C.No.01 of 2016 pending on the file of the XII Special Magistrate, Hyderabad, for the offence punishable u/ sec.136 of the Negotiable Instruments Act, and also the learned Public Prosecutor representing 1st respondent-State before ordering notice to the 2nd respondent/ complainant and perused the grounds urged in the quash petition and other material.

It is during trial, the complainant filed Crl.M.P.3041 of 2017 to examine one of the two witnesses by name G.Gopal Reddy of the so called letter dt.27.12.2016 said to have been executed by the A.2 representing the A.1 as its Managing Director. Undisputedly, the letter was already exhibited through P.W.1 as Ex.P.25 on 15.05.2017. Once such is the case, to prove the contents of the letter in support of the case of the complainant, the trial Court felt the need of the examination of the witness, there is nothing to interfere with the order impugned herein. In the result, the Criminal Petition is disposed of. Consequently, pending miscellaneous petitions, if any, shall stand closed.
