THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI CONTEMPT CASE No.830 of 2018 Between:

Dr.K.Jaya Shyam Sunder ..Petitioner and Dr.Y.Lalitha Kumari - Director, Public Health & Family Welfare Department, Government of Telangana, Sultan Bazar, Hyderabad ..Respondent Counsel for the petitioner: Mr.P.V.Krishnaiah Counsel for the respondent: Government Pleader for Services (T.S.) The Court made the following:

CVNR,J & KVL,J C.C.No.830 of 2018 ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This contempt case is filed alleging willful disobedience of order, dated 16.10.2017, in W.A.No.1533 of 2017. 2.

The grievance of the petitioner as projected in this contempt case is that despite the aforementioned order of this Court, the respondent has failed to consider whether, having regard to the contents of the written statement filed by the petitioner, the disciplinary proceedings shall be continued or not. 3.

On the petitioner's own showing, she participated in the subsequent stage of the disciplinary proceedings, which ultimately culminated in dropping the charges against her. She has also stated that the respondent has retired from service. She has not explained the reason for her not filing this contempt case at the point of time when the respondent has allegedly violated the order of this Court. In our opinion, after the disciplinary proceedings were closed and that too after the alleged contemnor demitted his office, it is not appropriate for this Court to entertain the contempt case filed alleging disobedience of the order passed during the course of the disciplinary proceedings.

4.

In the above view of the matter, we do not find any merit in this Contempt Case and the same is, accordingly, dismissed.

CVNR,J & KVL,J C.C.No.830 of 2018 5.

As a sequel to dismissal of the Contempt Case, C.A.No.1 of 2018 filed by the petitioner for interim relief stands dismissed as infructuous.
