HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.2109 of 2018 ORDER:

Heard both sides. Perused the impugned order. 2.

Undisputedly, Ex.A.1 is only a registration extract obtained from the Sub-Registrar and not a original document with original thumb impression of the 1st plaintiff-so-called vendor thereunder, even to order by setting aside the impugned order of the lower Court, dated 01.02.2018, in I.A.No.1744 of 2017, from the dispute as to the thumb impression of the 1st plaintiff by the plaintiffs in Exs.B.1 and B.2, leave about not even disputed by the defendants on the original of Ex.A.1, the question of sending registration extract of Ex.A.1, pursuant to the very prayer of the plaintiffs to send Exs.A.1, B.2 and B.2 with specimen thumb impression of the 1st plaintiff to comparison does not arise.

Accordingly, the civil revision petition is disposed of giving liberty to file original document and move afresh before the trial Court to consider on own merits.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
