THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.7292 & 12223 of 2016 COMMON ORDER:

These two writ petitions are being disposed of by this common order as they are filed by the same petitioner. The petitioner filed W.P. No.7292 of 2016 challenging the order dated 26.02.2016 relieving her from the post of Alternative School Co-ordinator (for short, "the ALSCO") in DPO, RVM (SSA), Karimnagar District.

W.P. No.12223 of 2016 was filed by the same petitioner challenging the Memo No.1804/SE.Prog.I/2014-3 dated 18.11.2015 and Memo No.1804/SE.Prog.I/2014-4 dated 08.01.2016 issued by respondent No.1 and consequential proceedings issued by respondent No.2 on 11.12.2015 and 25.02.2016. The petitioner was appointed as a School Assistant (Bio Science) on 21.01.2002. While she was working as School Assistant/Special Officer in K.G.B.V. School on deputation, she was transferred and posted as ALSCO in DPO, RVM (SSA), Karimnagar District for a period of one year by Memo dated 06.11.2014. She joined the duty on 25.11.2014. While she was working as ALSCO in the cadre of School Assistant, she was promoted as Gazetted Head Master by Regional Joint Director of Education by proceedings dated 14.07.2015.

Though she submitted a representation on 14.07.2015 to respondent No.1 requesting to allow her to continue as ALSCO in the cadre of Gazetted Head Master, she was not allowed to do so. The proceedings dated 11.12.2015 were issued repatriating the petitioner to her parent department i.e., School Education Department as per the orders in Government Memo

No.1804/SE.Prog.I/2014-3 dated 18.11.2015, which was followed by a Memo No.1804/SE.Prog.I/2014-4 dated 08.01.2016.

Ultimately, she was relieved on 26.02.2016 as ALSCO in DPO, RVM (SSA), Karimnagar District. Though she was promoted as Gazetted Head Master while she was working on deputation, her case was recommended for continuance even after promotion. It came to light during the course of arguments that after relieving of petitioner as ALSCO on 26.02.2016, she did not join anywhere. Learned counsel for the petitioner fairly submits that he will not press for the place sought for in these writ petitions, as the petitioner is not interested in continuing in the Sarva Siksha Abhiyan Scheme and she wants to continue in her parent department. Learned counsel further submits that the petitioner wants to render her services near the place of her parents and there is a vacant post of Gazetted Head Master in the Z.P. High School in Manakondur, Karimnagar District and she may be posted there and her case can be considered for posting in that place.

Since the present writ petitions are filed challenging the repatriation and in view of the request of petitioner at the time of arguments, these Writ Petitions are disposed of by directing the petitioner to submit a representation to respondent No.3 and report before respondent No.3 for appropriate orders as to posting, and it is hoped that respondent No.3 will consider the representation, keeping in view the circumstances explained by the petitioner in her representation. The petitioner is given two (2) weeks time from the date of receipt of a copy of this order for submitting the representation and reporting before respondent No.3. It is open to respondent No.3 to pass appropriate orders regulating the period during which the petitioner did not continue after relieving on

26.02.2016.

With the above observations, these Writ Petitions are disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
