None appears for the respondents, though served. Learned counsel for the appellants does not press this appeal and submits that the appellants shall pass order as per the impugned order, dated 23.11.2006, within four weeks from today.

By the impugned order, appellants were directed to consider the case of respondent No.1 i.e., original petitioner for regularisation with effect from the date of his completing five years of service i.e., 04.05.1996 and pass orders within four weeks from the date of receipt of the said order. Till today, appellants have not passed any order. In view thereof, we are satisfied that the following order shall meet the ends of justice:

Appeal is disposed of as not pressed. The appellants shall pass orders as per the impugned order within four weeks from the date of receipt of this order. It is needless to mention that the appellants shall pass orders

on merits in accordance with law.

Learned counsel for the appellants is directed to communicate this order to the appellants within a period of ten days from today.

Miscellaneous Petitions, if any, pending in this appeal also stand disposed of. No order as to costs. _____________________ DILIP B.
