THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.15025 OF 2004 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring Circular Memo No.Dev/DD Agents/04-05, dt.13.08.2004 issued by the 2nd respondent as arbitrary, illegal, violative of the fundamental rights guaranteed to the petitioners under Articles 14, 19 (1)(g) and 21 of the Constitution of India, without jurisdiction, violative of the provisions of Section 25 F of the Industrial Disputes Act as well as provisions of Section 47 of the A.P. Shops and Establishments Act, 1988 and consequently set aside the same."

On 25.08.2004, this Court passed an interim order in W.P.M.P.No.19450 of 2004 giving direction to the respondents not to implement the resolution, dated 24.07.2004, to discontinue the scheme of Day Deposits and also the services of the Day Deposit Agents passed by the Committee of Persons-in-charge of respondent No.1 Bank pending further orders. The said interim order was made absolute on 22.09.2005.

When the matter is taken up for hearing, it is informed by the learned counsel for the petitioners that the authorities have taken a decision to utilise the services of the petitioners herein in view of the proceedings vide Rc.No.Dev./DDA/2006-07, dated 17.04.2006, and the petitioners are continuing in the same service and therefore, the cause in this writ petition does not survive and no further orders are required to be passed in this Writ Petition.

Recording the said submission, this Writ Petition is disposed of as infructuous. There shall be no order as to costs. 5.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
