Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner is a Fair Price Shop Dealer of Shop No.0518 of Timminenipalem Village, Chintakhani Mandal, Khammam District, and his authorization is existing till 31.03.2016. While so, on 16.07.2014, the Deputy Tahsildar, Khammam Urban, came to the shop along with three panchayatdars and inspected the essential commodities. He found some variation in the stock, based on which, 6A proceedings were initiated before the 2nd respondent. However, the 3rd respondent suspended the authorization of the petitioner on 22.07.2014. Challenging the same, the present writ petition is filed.

3. The learned counsel for the petitioner submits that after suspension of the authorization on 22.07.2015, no show cause notice was issued till today and disciplinary proceedings have not been concluded.

4. In view of the pendency of disciplinary proceedings on the same ground of variation in the stock for which 6A proceedings were already initiated and for non-issuance of a show cause notice in order to complete the enquiry by the 3rd respondent, the impugned order dated 22.07.2014 of the 3rd respondent is suspended. However, the 3rd respondent is at liberty to issue a show cause notice giving time to the petitioner to submit his explanation, after filing of explanation by the petitioner consider the same and take necessary action after conducting the enquiry.

5. The Writ Petition is allowed to the extent indicated above. Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
