HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No. 1040 OF 2017 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (For short, 'the Cr.P.C.') to enlarge the petitioner on bail in Crime No.3 of 2017 of Airport Police Station, Visakhapatnam City. The petitioner allegedly committed offences punishable under Section 498-A and 306 read with Section 34 of IPC and he is in judicial custody since 04.01.2017. 2.

The case of the prosecution is that one Shanmukha Kalyani married A1 and they lead conjugal life for five months. Later, said Shanmukha Kalyani conceived, which was disliked by her in-laws and got aborted her pregnancy. In the same manner, they got her aborted for about three times. The daughter of the informant used to attend the house of her in-laws and when disputes arose between her daughter and her in-laws, the informant used to interfere and convince her daughter and manage the issue. In the same manner, in the month of December, the daughter of the informant came to her and informed that her husband and her in laws including sister-in-law were quarrelling with her round the clock and two days prior to her visit, the disputes became intensive. On 02.01.2017, between 1000 hours to 1400 hours, the daughter of the informant stayed with her and informed her that her husband (A1) challenged with her to do away her life as how her father killed her mother and went into the house. Later, she went inside her house, bolted the doors and committed suicide by hanging.

The main contention of the petitioner is that he is innocent of the offences alleged and is falsely implicated in the said crime. 4.

The allegations in the complaint clearly disclose that A1 subjected the deceased to cruelty and threatened her to kill her in the same manner as her

MSM, J Crl.P. No.1040 of 2017 father killed her mother and due to unbearable harassment by A1, she committed suicide. Since the complaint clearly discloses specific allegations against A1, his request for grant of bail is rejected. 5.

Accordingly, criminal petition is dismissed.
