CVNR, J & ANIS, J CMA.No.177 of 2005 Dt: 14.10.2016 Judgment: (Per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Civil Miscellaneous Appeal (CMA) arises out of Order and Decree, dated 27-01-2005, in OP.No.43 of 2002 on the file of the Senior Civil Judge, Proddatur, Kadapa District, whereby he has dismissed the OP filed by the appellant for dissolution of marriage with the respondent.
A perusal of the proceeding sheet shows that on 25.03.2015, this Court, while taking note of the fact that proof of service is not filed, granted four weeks time finally to file proof of service, failing which the CMA shall stand automatically dismissed without further reference to the order of the Court. On 22-04-2015, the appellant was permitted to send a fresh notice and to file proof thereof.
The office report shows that the proof of service has not been filed. At the hearing, no one appeared for the appellant.
