HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20374 of 2009 ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed seeking to declare G.O.Rt. No.5363 General Administration (Poll.D) Department, dated 12.09.2007, as illegal and arbitrary, and consequently, quash CC No.1 of 2007.
When the matter is taken up for hearing, it is informed that in a similar writ petition, the appointment of the 2nd respondent as a Public Prosecutor, as per the G.O.Rt.No.5363, dated 12.09.2007, was questioned, and that the 2nd respondent is not continuing as Public Prosecutor to prosecute the case i.e. CC No.1 of 2007, and that in view of the same, that writ petition was disposed of. Therefore, since the 2nd respondent is not continuing as a Public Prosecutor to prosecute the case CC No.1 of 2007 as per G.O.Rt.No.5363, dated 12.09.2007, nothing survives for adjudication in this writ petition. Hence, the Writ Petition is disposed of as infructuous. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
