THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15673 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for respondents.

The petitioner was appointed as a fair price shop dealer of shop No.31 of Bantapalli, H/o.Chelleli Chelimela Village of Devanakonda Mandal, Kurnool District and it was renewed from time to time. The last renewal expired on 3103-2015. Thereafter, the petitioner applied for renewal of license. While so, on the basis of report of Tahsildar, Devanakonda Mandal dated 0404-2015, the 3rd respondent issued show-cause notice dated 25-04-2015 while suspending the dealership of the petitioner under proceedings of even date. In the present writ petition, suspension of the dealership is challenged, but the show-cause notice was not filed.

Learned counsel for the petitioner submits that the show-cause notice was not served, whereas the suspension of the dealership on the same date was served.

Be that as it may, in view of the nature of the allegations, the petitioner is given opportunity to submit his explanation within a period of (15) days from the date of receipt of copy of the order and the 3rd respondent shall consider the said explanation and after following the principles of natural justice and binding decisions of this Court conduct enquiry and pass appropriate orders within a period of (30) days from the date of receipt of explanation. Accordingly, the Writ Petition is disposed of.

The miscellaneous petitions pending, if any, in this writ petition shall stand closed. There shall be no order as to costs.
