THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION Nos.10316, 10318, 10324, 10330, 10357, 10358, 10366, 10374 and 10377 of 2016 C O M M O N O R D E R Challenge in this batch of writ petitions is to the action of the Srikalahasti Municipality in trying to interfere with the house properties of the petitioners on Kothapeta (Puthalapattu-Naidupet Road), Srikalahasti Town, Chittoor District.
Sri Md. Saleem, learned Standing Counsel for the Srikalahasti Municipality, informed this Court that the petitioners had furnished undertakings to the effect that they would construct their buildings leaving a 5 feet gap but constructions were made in violation of this undertaking.
However, as the learned Standing Counsel admits to the effect that constructions are presently in existence and steps would have to be taken for demolishing the same for the purpose of road widening, the writ petitions are disposed of directing the Srikalahasti Municipality to strictly abide by the due procedure laid down by law in the event it seeks to interfere with the possession and enjoyment of the petitioners in this batch of cases over their house properties.
