THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.33824 of 2012 ORDER:

The petitioners state that they are the owners and possessors of the premises bearing municipal No.8-15-79/A, Mailardevpally, Rajendranagar, Hyderabad. They purchased the said plot in the year 1997 through a registered sale deed. They established a factory in the premises in the name and style of 'S.S.Polymers' by obtaining permission from the Factories Department and after obtaining licence. The factory was approved by the Pollution Control Board also. The electricity department gave connection after issuance of No Due Certificate by the respondents. The petitioners are tax payers. While so, when the respondents came to the factory on 25.10.2012 with police force and tried to dismantle the structures, the present writ petition was filed.

This Court, by order dated 30.10.2012, directed the respondents not to interfere with the premises of the petitioners, except otherwise following due process of law. The said order has been in operation and no counter affidavit is filed by the respondents till today. 3.

In view of the same, this writ petition is disposed of directing the respondents not to interfere with the premises of the petitioners claimed by them under the registered sale deed, except following the due process of law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
