THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.36636 OF 2015

O R D E R

The prayer of the petitioners in this case is as under: 'This Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of a Writ of Mandamus declaring the action of the Respondents 2 & 3 Police personnel in interfering the Civil disputes between the Petitioner and Un-official Respondent further pressurizing the Petitioners and his Family Members to settle the disputes as per the tunes of Un-Official Respondent is illegal, arbitrary and violation of Articles 19, 21 of the Constitution of India and consequently direct the Respondents 2 & 3 Police personnel to restrain in interfering the Civil disputes between the Petitioners and Un-official Respondent and also not pressurize the Petitioners to settle the disputes as per the tunes of Un-Official Respondent and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

The Sub-Inspector of Police, Guntakal I Town Police Station, Ananatapuram District, filed a counter-affidavit denying the petitioners' allegations. According to the Sub-Inspector, no complaint had been received leading to the registration of a FIR either against the petitioners or against the fourth respondent and therefore, the question of interference by the police authorities did not arise. Further, in paragraph 9 of the counter-affidavit, he stated that the police authorities never harassed, threatened and interfered with the civil disputes between the petitioners and the fourth respondent with regard to the land at any point of time.

The aforestated stand of the police authorities, which remains unrebutted, is duly taken on record. In the light thereof, no adjudication is warranted on merits in this case.

The writ petition is accordingly closed. Pending miscellaneous petitions shall also stand closed in the light of this final order. No order as

to costs.
