HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.4794 of 2015 ORDER:- This criminal petition is filed under Section 482 Cr.P.C., to quash the proceedings in C.C.No.1164 of 2014 on the file of the Additional Judicial Magistrate of First Class, Anantapur against the petitioners/accused. Heard learned Counsel appearing for the petitioner/accused and learned Additional Public Prosecutor representing the State. Petitioner No.1 is the husband of respondent No.2 and petitioner No.2 is the elder sister of petitioner No.1 and petitioner No.3 is the husband of petitioner No.2.

The allegation against the petitioners is that they harassed the de facto complainant physically and mentally and also demanded additional dowry After arguing some time, learned Counsel for the petitioners while not pressing the main prayer, requested this Court to dispense with the presence of the petitioners in the trial Court. Considering the facts and circumstances of the case, the trial Court shall proceed with the trial of the case. However, the petitioners No.2 and 3 are directed to appear before the trial Court when they are proposed to be examined under Section 239 Cr.P.C., and after completion of the said examination, the presence of the petitioners No.2 and 3 is dispensed with till the date of their examination under Section 313 Cr.P.C. With the above direction, the Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
