THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3310 OF 2022 ORDER:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner/Accused in the event of his arrest in Crime No.341 of 2022 on the file of Meerpet Police Station, Rachakonda, for the offences punishable under Sections 504 and 506 of Indian Penal Code and Section 3(1)(r)(s), 3(2)(Va) SC/ST POA Act.

Heard learned counsel for petitioner/Accused and learned Assistant Public Prosecutor for respondent-State. Notice served on the defacto complainant/2nd respondent and proof of service is filed by the learned counsel for the petitioner. Perused the record. 3.
The facts of the case are that the petitioner was married to one Swetha in the year 2019 and later disputes arose in their matrimonial life. However, due to some photographs being taken and also there was an allegation of illicit affair between the defacto complainant and one Narmada, the defacto complainant questioned the petitioner as to why he was exhibiting photographs to known
persons, the petitioner abused the defacto complainant in the name of his caste.

Except the bare allegation of abusing, there is no other allegation against this petitioner.

In the said circumstances, this court is inclined to grant Anticipatory Bail to the petitioner/Accused.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused shall be enlarged on bail in the event of his arrest subject to the following conditions:
i) The petitioner/Accused is directed to surrender before the Station House Officer, Meerpet Police Station, Rachakonda, within a period of ten (10) days from today, and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties to the like sum each to its satisfaction.
ii) The petitioner/Accused shall appear before the investigating authorities as and when required.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
