THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2025 OF 2015 ORDER:

This Criminal Revision Case is filed by the petitioner, challenging the order, dated 16.06.2015 passed in Crl.M.P. No.1382 of 2013 in C.C. No.430 of 2015 by the IV Additional Judicial Civil Judge, Guntur.

Heard and perused the material available on record. The petitioner is doing business in insecticides. The first respondent conducted raid at the premises of the petitioner firm and seized the stock available in the premises, on the ground that the petitioner is doing business without incorporating some of products in their approved principal Certificate. The petitioner filed Crl.M.P. No.1382 of 2015 before the Court below seeking release of the stock. The learned Judge allowed the said application vide impugned order on condition of petitioner depositing Rs.20,00,000/-, which is the value of the stock seized. Aggrieved by the said order, the present revision is filed.

Having regard to the facts and circumstances of the case, without expressing any opinion on the merits of the case, this Criminal Revision Case is disposed of modifying the order under revision, as follows: The IV Additional Junior Civil Judge, Guntur is directed to release the stock of the petitioner on petitioner executing a personal bond for a sum of Rs.10,00,000/- (Rupees ten lakhs only) with one surety for the like sum to the satisfaction of the said Judge.

Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J October 28, 2015 KTL
