This Writ Petition is filed alleging that on 28.05.2019 a representation was submitted to the Hyderabad Metro Development Authority (HMDA) contending that respondent No.6 is making residential plots in the agricultural land to an extent of Acs.10.20 guntas in Survey Nos.735 and Acs.2.03 guntas in Survey No.785 of Upperpally Village, Shamirpet Mandal, MedchalMalkajgiri District. 3.
From the material on record, it is apparent that petitioner and another person instituted O.S.No.754 of 2008 pending in the Court of V Additional District Judge, Rangareddy District praying to declare the registered sale deeds of the subject lands in favour of defendants3 and 4 as illegal; pass preliminary decree in favour of the plaintiffs by allotting 1/4th share each and pass final decree in favour of the plaintiffs. The prayer itself would show that there was further sale transaction by the alleged petitioner's coparceners. Petitioner also filed interlocutory application seeking to change the nature of the suit schedule property. 4.
According to learned Standing Counsel, no application was submitted by respondent No.6 and the claim itself is premature. 5.
Since it is the categorical assertion of HMDA that no layout application was submitted and layout is not granted and if the petitioner has apprehension that the unofficial respondent No.6 is
forming residential plots, he has to work out his remedies as available in law.

The Writ Petition is accordingly dismissed.
