HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.19095 OF 2007 ORDER:

This writ petition is filed seeking a direction to the respondents to grant special grade increment with effect from 2004 to the petitioner after completion of 12 years of service from the date of initial appointment by counting the continuity of service granted by the Labour Court in I.D.No.614 of 1992 on 7.2.1995 with all consequential benefits including re-fixation of pay and arrears.

When the matter is taken up for hearing, learned counsel for the petitioner submits that in pursuance of the interlocutory order dated 10.09.2007, passed by this Court in W.P.M.P.No.24552 of 2009, the representation dated 27.6.2006, submitted by the petitioner was considered and rejected, therefore, the cause in the writ petition does not survive and liberty may be given to challenge the said rejection order.

In view of the above, the writ petition is dismissed giving liberty to the petitioner to challenge the rejection order said to have been passed by the respondents, before the appropriate Forum. No order as to costs.

Miscellaneous Petitions, if any pending in this writ petition shall also stand closed.
