THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.31042 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the inaction of the respondents in not taking steps on the petitioners' representations dated 28.02.2011, 18.04.2011, 21.12.2011, 15.02.2012, 09.01.2014, 25.06.2014, 21.67.2014, 23.08.2014 and 10.8.2015 for the upgradation of the existing "Bala Kendra" to a "Bala Bhavan" at premises No.3C-30-19 and 3C16-3 and 4, situated at Padamaraveedhi, West Godavari Districtin Eluru in accordance with the terms of Memo No. 15986/PE.PROG.II/ A2/2006 dated 15.2.2011 and the conditions in the gift deed executed by the petitioner in favour of the 3rd respondent on 17.2.2011, as arbitrary, unjust and violative of Article 14of the Constitution of India and consequently direct the respondents to forthwith take steps on the petitioner's representations in accordance with law." Heard Sri M.V. Pratap Kumar, learned counsel for the petitioner and learned Government Pleaders for School Education and Revenue for respondents, apart from perusing the material available before this Court.
Today, when the matter is called, it is submitted by the learned counsel for the petitioner that for redressal of the grievance of the petitioner herein, the petitioner submitted a representation on 10-08-2015 with the respondent authorities and no action has been taken on the said representation till date. Taking into consideration the nature of controversy, this Court is of the considered opinion that ends of justice would be met if a direction is issued to the respondents to take appropriate
action the representation, dated 10-08-2015 said to have been submitted by the petitioner herein by fixing some time frame. For the aforesaid reasons, without expressing any opinion on the merits of the matter, this writ petition is disposed of, directing the respondents herein to consider the representation, dated 10-08-2015 submitted by the petitioner herein and pass appropriate orders on the same, within a period of two (2) months from the date of receipt of a copy of this order, in accordance with law.
