THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3282 of 2022 ORDER:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner/accused seeking bail in the event of his arrest in connection with Crime No. 126 of 2022 on the file of Hanamkonda Police Station, Warangal, registered for the offences punishable under Sections 417, 420, 376(2)(n) of IPC.

The allegation against the petitioner is that in March, 2021 the petitioner took the defacto complainant to his room and stated that he liked her and they got physically intimate. Thereafter, the petitioner avoided the defacto complainant and finally on 17.03.2022 i.e. after one year, the present complaint came to be filed. Even according to the complaint, it was a solitary incident with the consent of the defacto complainant. Both the defacto complainant and the petitioner are working as constables.

Since there is no allegation of any force by the petitioner, the petitioner can be granted the relief of Anticipatory Bail subject to the following terms and conditions:

1) The petitioners/ accused is directed to surrender before the Station House Officer, Hanamkonda Police Station, Warangal District, and on such surrender, the said Station House Officer shall release the petitioner/ accused on bail on his executing a personal bond to the tune of Rs.20,000/- (Rupees twenty thousand only) with two sureties to the like sum each to his satisfaction.

2) The petitioner/ accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.

3) The petitioner/accused shall attend the concerned police station as and when required. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
