HONOURABLE SRI JUSTICE P. NAVEEN RAO Writ Petition No.25789 of 2015 ORDER :

Alleging that petitioners have encroached into the road leading to Kodumuru and the same is objectionable, Notice, dated 27-02-2015 was served on petitioners calling for their explanation. The petitioners claimed to have submitted explanation in the form of legal notice in response to the said notice. Alleging that without passing orders on the explanation given by petitioners, the Respondent - Nagara Panchayat is taking coercive steps to remove the alleged encroachments.

2. The learned Standing Counsel, on instructions, submits that Nagara Panchayat shall follow detailed procedure and shall not take any course of action against petitioners until orders are passed after considering the explanation submitted by petitioners.

3. Having regard to the said statement, the Writ Petition is disposed of directing the Respondent - Nagara Panchayat to consider the explanation submitted by petitioners and pass orders as warranted by law. Until orders are passed, they shall not take any coercive steps against petitioners.

4. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand dismissed. There shall be no order as to costs.
