The Criminal Appeal was posted on 09.11.2017. There was no representation for the appellant. Even though the matter is posted today in the caption 'For Dismissal', none appeared. As per the material placed on record, the appellant was absent before the Court below since 15.04.2005, as such, the Court below dismissed the subject C.C.No.1027 of 2004 and acquitted the accused under Section 256(1) Cr.P.C. The findings of the Court below are based on record. There is nothing to take a different view.

Therefore, the impugned order is confirmed and the Criminal Appeal is dismissed.
