HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos. 1240 and 5329 of 2002 ORDER:

W.P.No.1240 of 2002 is filed by petitioner under Article 226 of the Constitution of India seeking a writ of mandamus to declare the inaction on the part of respondents in not promoting him from the post of Record Assistant to the post of Junior Lecturer in Economics in Raghavendra Junior College (Aided), Allagadda, Kurnool District, as illegal and arbitrary and a consequential direction is also sought to the respondents to relax G.O.Ms.No.203 dated 18.06.1999 and other relevant G.Os in the case of the petitioner in promoting him to the post of Junior Lecturer in Economics, while W.P.No.5329 of 2002 is filed seeking a writ of certiorari to call for the records relating to proceedings in Rc.No.54/Apl./Recruitment/2001 dated 30.12.2001 issued by the Correspondent, Raghavendra Junior College (Aided), Allagadda, Kurnool District and quash the same. 2.

Heard Sri S. Rajeswar Reddy, learned counsel for the petitioner.

When the matters are taken up for hearing, learned counsel for the petitioner has stated that G.O.Ms.No.203 dated 18.06.1999 was challenged in W.P.No.24916 of 2002 and the same is pending adjudication.

In view of the above submission, I am of the view that no relief can be granted in the present writ petitions, until and unless the said G.O. is set aside and a panel of promotion for the post of Junior Lecturer from the feeder category of Record Assistant is created by the respondents. If the petitioner succeeds in W.P.No.24916 of 2002, his case would be considered for promotion to the post of Junior Lecturer. Therefore, the cause in the writ petitions does not survive for adjudication.

Accordingly, both the Writ Petitions are dismissed as infructuous. Consequently, miscellaneous petitions if any pending in the writ petitions shall stand closed.
