HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.3847 of 2018 ORDER :

The petitioner is apprehending as being implicated as one of the accused in Crime No.351 of 2017 registered by the Neredmet Police Station, Rachakonda Commissionerate, from the report of the 2nd respondent/de facto complainant, dated 10.05.2017, of the alleged incident partly happened on 09.05.2017 around 10.00 a.m. and partly happened on the night before 7 p.m.. There is a stray reference to the owners and not even mentioned the name of the petitioner and he was not even from the very report witness to who came and locked and thrown the alleged samans from inside to have any basis. Leave it as it is, in his complaint given to the Human Rights Commission stated that on 09.05.2017 after office hours the alleged incident if at all happened on 09.05.2017 at about 10.30 a.m. at the so-called house when he was there, some unknown persons allegedly tried to attack and he closed the door and jumped the wall not even mentioned. 2.

As per the submission of learned Public Prosecutor only three witnesses examined so far and the investigation is in stand still. As on now there is nothing to show the petitioner is accused of the crime. In the absence of which there is nothing to quash the crime so far as against the petitioner merely because happened to be the owner of the property.

Having regard to the above, the police are directed to complete the investigation and file the final report of the out come of investigation by 22.12.2018 before the learned Magistrate Court concerned, by following the time frame supra. Other remedies are left open.

With the above direction, the criminal petition is disposed of. Miscellaneous petitions pending, if any, in the criminal petition shall stand closed.
