THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12899 of 2019 ORDER:

With the consent of both the parties, this Writ Petition is disposed of at the admission stage.

This Writ Petition is filed for the following relief: ".........Writ of Mandamus, by declaring the in action of the respondents in fixing my cadre and including petitioner name in panel of Tahsildar as illegal, arbitrary and in violation of Article 14, 19 and 21 of the Constitution of India and consequently direct the respondents to fix petitioner cadre and include petitioner name in panel of Tahsildar as per the recommendations of the Collector, Khammam District dated 04.07.2018 and pass such other order...."

Heard Sri N.Praveen Kumar, learned counsel for the petitioner and the learned Government Pleader for Services-II. It has been contended by the petitioner that he has retired from service as Senior Assistant on 30.04.2009 in A.P.State Revenue Department. The grievance of the petitioner is that the respondents have not fixed the cadre strength and included his name in the panel of Tahsildar. Therefore, the petitioner submitted a representation on 30.04.2018 to the District Collector-3rd respondent who in turn forwarded a letter dated 04.07.2018 to the 2nd respondent recommending the case of the petitioner to fix his date of seniority w.e.f., from 23.06.1984 and consider his case for promotion to the post of Tahsildar. Inspite of 3rd

respondent recommending the case of the petitioner, the 2nd respondent had not considered the case of the petitioner. Thereafter, petitioner made a series of representations to the 2nd respondent requesting to consider his case for promotion to the post of Tahsildar duly taking into consideration the recommendations of the 3rd respondent. But so far, the 2nd respondent has not passed any orders on the representation submitted by the petitioner.

Learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the 2nd respondent to consider the representation submitted by the petitioner on 30.04.2018 and pass appropriate orders in accordance with law.

Learned Government Pleader for respondents submits that the case of the petitioner would be considered and appropriate orders would be passed on the representation submitted by the petitioner on 30.04.2018 in accordance with law.

This Court, having considered the rival submissions made by the learned counsel on either side, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 30.04.2018 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of copy of this order.

With the above observations, the Writ Petition is disposed of. No order as to costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
