THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.14718 of 2017 ORDER:

This Writ Petition is filed challenging registration of FIR No.67 of 2017 on the basis of the complaint lodged by Naib Tahsildar (Enforcement).

A reading of the complaint discloses the checking of the godown of premises belonging to the petitioner and others, PDS rice bags numbering 300 plastic bags weighing approximately 150 quintals value of Rs.1,80,000/- were noticed and the said rice bags were seized under cover of panchanama. The checking parties tried to locate two other persons, including the petitioner herein, and they were found absconding. The Enforcement Naib Tahsildar lodged a complaint along with panchanama reports.

In view of the said complaint, it cannot be said that registration of the crime is bad in law. It is for the second respondent to go ahead with the investigation by duly following the procedure, including Section 41-A of Cr.P.C.

In the circumstances, this Court is not inclined to entertain the present Writ Petition, and the same is, accordingly, dismissed.
