THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.3560 OF 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the first respondent in issuing proceedings in Rc.No.54/2004.A1, dated 31.01.2004 denying promotion to the petitioner and promoting respondent Nos.2 to 8 as Senior Managers as arbitrary, illegal, violative of the "Service Rules of the Employees of the Girijan Cooperative Corporation Limited, Visakhapatnam", violative of the principles of natural justice and violative of the Fundamental Right guaranteed to the petitioner under the Constitution of India and direct the respondents to promote the petitioner to the post of Senior Manager with effect from the date on which respondent Nos.2 to 8 are promoted with all consequential benefits.

The writ petition against respondent Nos.2 to 8, who are the contesting respondents, was dismissed on 29.12.2010. In view of the dismissal of the writ petition against respondent Nos.2 to 8, the cause in this writ petition does not survive for adjudication. Hence, the Writ Petition is dismissed. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
