HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.8573 of 2016 ORDER:
Petitioners' grievance is that they have presented a document before respondent No.3 in respect of the subject land but respondent No.3 is insisting them to produce 'No Objection Certificate' from the Revenue Authorities, as a condition precedent for registering the document.
Learned Government Pleader for Revenue appearing for respondents states that the SubRegistrar/respondent No.3 will receive documents submitted by the petitioner for registration, if it is presented within two weeks from the date of receipt of a copy of this order and that if he does not wish to register, he will pass an order under Section 71 of the Registration Act, 1908, giving reasons why he does not wish to register it and indicating why he is insisting on 'No Objection Certificate' to be produced by the petitioner.
In view of the said submission, the Writ Petition is
disposed of directing respondent No.3 to receive the documents submitted by the petitioner for registration within two weeks from the date of receipt of a copy of this order and on presentation of such documents respondent No.3 will pass orders within four weeks under Section 71 of the Registration Act, 1908, in case he does not wish to register it. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
