Uranium Workers Union (Regd.No.48/2014), v. The Union Of India,
HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.36798 of 2016 ORDER:
Heard the learned counsel for the petitioner and Sri P.Sri Harsha Reddy, learned counsel for respondent Nos.2 and 3. 2.
Petitioner is a registered union of the workmen employed in the 2nd respondent Corporation and has filed this Writ Petition challenging the inaction of 2nd respondent in extending benefits of House Rent Allowance to the members of the petitioner's union working under the control of 3rd respondent while extending such benefits to other categories of employees in the same unit. 3.
Petitioner also seeks benefit like children educational allowance and conveyance allowance and contends that such discrimination against the members of the petitioners-union violates Articles 14 and 21 of the Constitution of India and the provisions of the Industrial Disputes Act, 1947 (for brevity 'the Act, 1947) and other laws.
4.
Admittedly the petitioner being union has remedy of seeking relief under Section 10 of the Act, 1947 and approaching the concerned Industrial Tribunal for adjudication of this dispute. 5.
Therefore, I am not inclined to entertain the Writ Petition. In view of the said alternative remedy, the Writ Petition is
MSR,J W.P.No.36798 of 2016 dismissed granting liberty to the petitioner to avail the remedy under the Industrial Disputes Act, 1947.
6.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
