Mother of the petitioners while working in Health Office, TTD, Tirumala, died on 01.04.2012. She was survived by four children, who are the petitioners herein. First petitioner was provided appointment as Canteen Server on compassionate grounds vide proceedings dated 19.07.2013 and is working in the said post. Four children of the deceased employee claimed payment of death benefits. By proceedings dated 31.08.2013, first petitioner was directed to produce Succession Certificate or else the death benefits of late M.Krishnamma would be settled equally between all the four sons of the deceased employee. First petitioner vide his representation, dated 11.08.

2016, informed the Executive Officer, TTD, that he is no more interested in claiming the death benefits as he was already provided employment on compassionate grounds and that the death benefits be paid to three other brothers. This writ petition is filed praying to set aside the order dated 31.08.2013 directing the petitioner to produce Succession Certificate even though first petitioner has given no objection for payment of benefits in favour of petitioners 2 to 4. 2.

Since first petitioner has given up the claim of death benefits of his late mother, there cannot be any impediment in payment of death benefits to other eligible persons.

Thus, writ petition is disposed of directing the authorities of Tirumala Tirupati Devasthanams, Tirupati, to pay the death benefits standing to the account of late M.Krishnamma to the

petitioners 2 to 4. It is open to the competent authority, TTD, to verify whether there are any other claims, before settling the amounts standing in the account of late M.Krishnamma. If there is no other claim, the benefits should be released to the petitioners 2 to 4 as expeditiously as possible, preferably within a period of four weeks from the date of receipt of copy of this order. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO kkm
