THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13271 OF 2015 ORDER:
This criminal petition under Section 482 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking to relax the condition imposed by order dated 23.10.2015, in Crl.M.P.No.719 of 2015 by the Judicial First Class Magistrate at Devarakonda, Nalgonda District, to the effect that the petitioner shall attend before the Station House Officer Chinthapally Police Station, on every Sunday in between 10.00 a.m., and 5.00 p.m., till filing of charge sheet. Heard and perused the records.
Learned counsel for the petitioner submits that the petitioner has been complying with the said condition till date. He further submits that the petitioner is a business man and is looking after his wife and two minor children and as such, attending before the SHO, Chinthapally P.S., is very difficult for him, as the same is 170 km away from Hyderabad. Hence, he seeks to relax the said condition. Considering the facts and circumstances of the case, the condition that the petitioner shall attend before the Station House Officer Chinthapally Police Station, on every Sunday in between 10.00 a.m., and 5.00 p.m., till filing of charge sheet, is hereby relaxed.
