HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30977 of 2016 ORDER:

1) Heard learned counsel for the petitioners and Government Pleader for Revenue. With the consent of both the parties, the writ petition is heard at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not issuing pattadar pass books and title deeds in pursuance of orders dated 23.05.1966 passed in proceedings S.R.No.467/ 22(a)/ 63PEL by the Assistant Settlement Officer, Nellore, pertaining to land admeasuring Ac.127-68 cents in Sy.Nos.128/ 1 and 128/ 2 of Irasalagundam, Konakalametla Mandal, Prakasham District, as illegal, arbitrary and violative of principles of natural justice; and consequently direct the respondents to issue pattadar pass books and title deeds in favour of the petitioners.

3) The grievance of the petitioners appears to be that pattadar pass books and title deeds were not issued in their favour though the Assistant Settlement Officer, Nellore issued proceedings. 4) The Government Pleader for Revenue would submit that the petitioners are required to make an application in the prescribed form, in which event the same shall be considered in accordance with law.

5) Giving liberty to the petitioners to make fresh applications as per the procedure prescribed, the present writ petition is disposed of. In the event of such applications being made by the petitioners, the authorities shall consider the same and pass orders in accordance with law as early as possible, preferably, within a period of six weeks from the date of receipt of the said application. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
