HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.14530 of 2013 ORDER :
The petition is filed by the petitioner/A-4 under Section 482 Cr.P.C to quash the proceedings in C.C. No.1703 of 2012 on the file of Additional Judicial Magistrate of the First Class, Tiruvuru, Krishna District which is the outcome of Crime No.18/2012, dated 28.01.2012 of Tiruvuru Police Station, Krishna District for the offences punishable under Sections 403, 408, 420 read with 34 I.P.C and Sections 7(1)(a) of the Essential Commodities Act.
2) It is the submission that already the learned Magistrate discharged A-1 and A-8 basically on the ground of no sanction is obtained as required under the Andhra Pradesh State Public Distribution System (Control) Order, 2008 and the petitioner/A-4 is covered thereunder. Hence, remedy is left open to approach the same Court pursuant to said discharge order. It is without any prejudice and to impugn if at all such order.
3) In the result, the criminal petition is disposed of and the learned Magistrate, after hearing, shall dispose of the application, to be filed by the petitioners, under Section 239 Cr.P.C, within one month from the date of such filing.
