Heard learned counsel for petitioner and learned Government Pleader for Revenue.

Petitioner claims that land to an extent of Ac.8.02 guntas in Survey No.69 of Gangannapet village, Utnoor mandal, Adilabad district owned by his father and after demise of his father, name of his elder brother i.e., Fakruddin was entered in the revenue records during the period from 1967 to 2013. Thereafter, on demise of Mr Fakruddin, the entire property was partitioned among the family members and property covered in the instant writ petition fallen to the share of petitioner. 3.

Petitioner alleges that after acquisition of land by ITDA, petitioner is in possession of land to an extent of Ac.0.21 guntas in Survey No. 69, Gangannapeta village which was sub divided plots and Survey No. 69/1/AA was assigned. Though name of petitioner was mutated and pattadar pass books and title deeds were issued, petitioner alleges that when respondent authorities tried to interfere with his possession and enjoyment, he submitted an application for conducting survey and demarcation of his land to avoid further litigation. Copy of FLine petition acknowledged by TSTS Limited dated 16.2.2019 is filed as Ex.P1. Alleging that no further steps are taken pursuant to said application, this writ petition is filed.

Since petitioner claims to have sought for conducting of survey and application has been made, without expressing any opinion on the claim made by the petitioner in the affidavit filed along with writ

petition regarding ownership, 4th respondent is directed to process the application submitted by the petitioner to conduct the survey by following due process of law and communicate the decision to the petitioner within two weeks from the date of receipt of copy of this order.
