When the matter is taken up, it is submitted by the learned counsel for the petitioner and the learned Government Pleader that in an identical set of circumstances this Court passed order in W.P.No.18863 of 2017 dated 12.06.2017 and the copy of the same is placed on record. 3.

Having regard to the said order passed by this Court in W.P.No.18863 of 2017 dated 12.06.2017, this Writ Petition is disposed of, directing the petitioner herein to make an application to the Deputy Commissioner, Prohibition and Excise, Suryapet District, Nalgonda enclosing thereto a Fixed Deposit Receipt drawn in favour of the Deputy Commissioner on any nationalised bank for the amount as assessed by the Motor Vehicles Inspector and on such application being made, the vehicle i.e., Mahindra Bolero Maxi Truck Plus bearing registration No.TS-05-UB-1901 shall be released for interim custody of the petitioner herein subject to the final orders to be passed in the criminal case and also on production of original R.C.Book.

It is further directed that the petitioner shall not alienate, change the physical features of the vehicle and shall give an undertaking to produce the vehicle as and when required by the Court till the disposal of the criminal case. However, it is made clear that the present order will not stand in the way of any confiscation proceedings and if already confiscation orders are passed, this order need not be given effect to. As a sequel, the miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 31.07.
