THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.35756 of 2015 ORDER:

The petitioners sought a Writ of Mandamus to the Commissioner of Police, Hyderabad, and the Deputy Commissioner of Police, North Zone, Secunderabad, to act upon their complaint dated 24.09.2015 and order a departmental enquiry into a particular incident.

In the body of the affidavit, the petitioners did not disclose that they had already approached the State Human Rights Commission in relation to the same grievance and that the matter was pending before the Commission. When the petitioners invoked the extraordinary jurisdiction of this Court under Article 226 of the Constitution, they were required to disclose full information and not suppress facts as per their liking.

A litigant is expected to approach the Court with clean hands. The failure on the part of the petitioners to do so disentitles them to any relief in this writ petition, which is a clear abuse of the process of the Court. The writ petition is accordingly dismissed on this short ground. This order shall however not preclude the petitioners from pursuing their remedies before the Commission.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
