THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CRIMINAL PETITION No. 3465 of 2019 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings in Spl.S.C.No.25 of 2019, on the file of V Additional Sessions Judge & Special Court for SC/ST Cases, Adilabad, against the petitioner/A.3 with respect to Crime No.225 of 2018, of Asifabad Police Station, registered for the offences punishable under Sections 3 & 4 of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, read with Sections 511 and 34 IPC.

Learned counsel for the petitioner submits that charge-sheet is filed in the said crime, but, it does not indicate any allegation against the petitioner, thus, there is no case made out against the petitioner.

Learned Public Prosecutor opposed this Criminal Petition. From a careful perusal of the charge-sheet, it is evident that there are certain general allegations levelled against the petitioner. Therefore, this Court is of the opinion that this is not a fit case for quashing the proceedings against the petitioner in the aforesaid crime.

In view of the above and as charge-sheet has already been filed in the aforesaid crime, personal appearance of the

CKR, J Crl.P.No.3465 of 2019 petitioner/A.3 is hereby dispensed with in Spl.S.C.No.25 of 2019 till commencement of the trial. However, it is open for the petitioner to file a petition for discharge before the trial Court. Subject to the above, the Criminal Petition is disposed of. Consequently, pending miscellaneous petitions, if any, shall stand closed.
