THE HON'BLE SRI JUSTICE R.KANTHA RAO CRIMINAL PETITION No.15376 of 2013 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. seeking anticipatory bail for the petitioner/accused in Cr.No.478/2013 on the file of Khammam I Town Police Station, Khammam District, registered for the offence punishable under section 420 of IPC. Heard the learned counsel appearing for the petitioner/accused and the learned Additional Public Prosecutor, representing the State. The petitioner/accused is said to be the Agent of Prathibha Gold Company. It is alleged that the petitioner/accused collected some amount from the de facto complainant who is a subscriber and did not repay the amount even after maturity of the bond. It is further alleged that the petitioner/accused in similar capacity collected huge amounts from several subscribers and failed to repay the amounts. The learned counsel for the petitioner/accused submits that the petitioner/accused is only a sub-agent and the Company has to repay the amount to the de facto complainant.

I am not inclined to accept the contention urged by the learned counsel for the petitioner/accused. The petitioner/accused is not entitled for anticipatory bail in a case of this nature. Accordingly the Criminal Petition is dismissed. _____________________ R.KANTHA RAO,J Date: 31.12.2013 Dsr
