HON'BLE SMT.JUSTICE G.ANUPAMA CHAKRAVARTHY CRIMINAL PETITION No.4653 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973, seeking anticipatory bail to the petitioners, who are arrayed as accused Nos.3 and 5 in the event of their arrest in Cr.No.279 of 2023 on the file of Dundigal Police Station, Cyberabad, registered for the offences punishable under Sections 498-A and 306 of Indian Penal Code.

Heard learned counsel for the petitioners-accused Nos.3 and 5 and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The case of the prosecution, in brief, is that the petitioners are co-sisters of the deceased. The allegations levelled against the petitioners are that along with accused No.1, who is the husband of the deceased, they harassed the deceased and also abetted the deceased to commit suicide.

Learned counsel for the petitioners contended that the entire incident took place at Dundigal, Cyberabad, and the petitioners are

residing at Kolanur Village, Odela Mandal, Karimnagar District, and they are innocent.

Taking into consideration the fact that the petitioners are living in Kolanur Village and except bald allegations, no specific allegations are levelled against them in the complaint, this Court is of the considered view that the relief of anticipatory bail can be granted to the petitionersaccused Nos.3 and 5. 6.

Accordingly, the Criminal Petition is allowed and the petitionersaccused Nos.3 and 5 shall be enlarged on bail in the event of their arrest subject to the following conditions:

i) The petitioners-accused Nos.3 and 5 are directed to surrender before the VIII Metropolitan Magistrate, Cyberabad at Medchal, on or before 18.05.2023, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two sureties for a like sum each, to the satisfaction of the learned Magistrate.

ii) The petitioners-accused Nos.3 and 5 shall appear before the concerned Station House Officer on every fortnight, that too on Monday between 10.00 AM and 05.00 PM till the date of filing of charge sheet.

iii) The petitioners-accused Nos.3 and 5 shall abide by the other conditions stipulated in Section 438(3) Cr.P.C. 7.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
